Can schools ban sexting — at home?

Schools have enough problems controlling students and cell phones in the classroom — but that hasn’t stopped New York City from stepping up the fight:

New York’s education department wants a ban on sexting (and cyberbullying) inside and outside school walls.

Students caught sending sexually explicit images of themselves or other underage students could face a 90-day suspension under a zero-tolerance ban.

Even if New York’s school board approved it, the city would face a legal challenge. The ACLU is already up in arms: “What on earth is that? It is a vague, undefined prohibition that impacts expression outside the school,” says Donna Lieberman of New York’s Civil Liberties Union.

Not so, says New York’s schools chancellor, Joel Klein: “We’ve always been respectful of First Amendment rights. I think we’ll get the right balance here.”
